Contract Terms & Conditions

This Subscription Contract ("Contract") stipulates the Terms and conditions to be signed by and between Kuwait Telecom Company and Subscriber. (Collectively referred to as "Parties" and individually as "Party"). The Contract shall be effective from the date of signature by the Parties.

First: Definitions

Company:Kuwait Telecom Company. K.S.C ("stc")

Subscriber:The natural or legal person contracted with the company through a subscription request to obtain its services.

Subscription Number:The specific designated number assigned to the subscriber to benefit from the company’s various services.

Tariff:The specific price set by the company for different services, such as the cost per minute for local or international calls, internet usage, or SMS charges.

Activation Fee:The financial amount paid by the subscriber to the company in exchange for activating the subscription and accessing the services.

Package:A set of services provided by the company under a subscription number for a fixed monthly fee.

Services:Each service provided by the company to the subscriber, including but not limited to (receiving and making calls, sending SMS and multimedia messages via the telecommunications network. Service details are available at customer service centers or on the company’s official website).

Payment System (Prepaid or Postpaid):For prepaid, the subscriber committed to pay the financial amount in advance to benefit from the contracted services. For postpaid, the subscriber pays the committed financial amount through invoices issued for the value of the contracted services used.

IMEI stands for “International Mobile Equipment Identity”the code that uniquely identifies a device such as mobility handset, tablet, router and any other unit which carries a unique IMEI

Second: Services

The company provides services to the subscriber in accordance with the billing system.
If the subscriber wishes to add or cancel any service, they must follow the specific instructions for each service.
The company has the right to modify, suspend, or cancel any of its services while notifying the subscriber, without affecting the contract duration or existing services. This is in accordance with the terms and conditions stipulated by the relevant regulations of the Communications and Information Technology Regulatory Authority.
Value-added services are automatically renewed according to the duration of each service unless the subscriber cancels them before the renewal date.
If the subscriber benefits from any additional services or features under a commitment contract, the original package will be reinstated without the additional services or features and at the same original package price on a monthly basis after the commitment period ends.

Third: Service Quality

The company provides its services to subscribers around the clock. In case of service interruption, necessary actions will be taken to resolve the issue as soon as possible.
The customer acknowledges that the company does not guarantee service availability in all areas with uninterrupted or interference-free quality due to technical or external factors. And the company may temporarily suspend the services to conduct maintenance or network repairs.

Fourth: Subscription and Payment

The subscriber agrees to pay the services Tariff for services they requested or benefited from, whether used by them or another person, partially or fully.
The subscriber has the right to change the payment system, provided they meet the company’s requirements and conditions for the requested change.
The company may require the subscriber to make an advance payment for devices or services provided with a subscription package, as agreed upon in the contract and subject to customer approval.
The company has the right to settle the subscriber’s outstanding bills from other subscriptions by deducting from the available balance, subject to the subscriber’s approval.
If the original or digital Civil ID (Kuwait Mobile ID) expires according to the company›s announced regulations, the subscriber will lose their subscription number, associated services, and any remaining balance after due notifications and warnings regarding the cancellation of the number.
The subscriber acknowledges that the monthly bill is issued on the 1st of each month. The company has the right to change the billing date after notifying the subscriber of the new date.
If the subscriber disputes the validity of a billed amount, the claim for that amount will be suspended until the complaint is resolved. However, the subscriber must continue paying undisputed amounts within the specified billing period. If the dispute is proven invalid, the subscriber must settle the disputed amount.
The company has the right to modify tariffs, fees, charges, monthly subscriptions, and validity periods, provided that the customer is informed of these changes in accordance with the related regulations and laws set by the Communications and Information Technology Regulatory Authority.
Upon completion of the special offer commitment period, stc reserves the right to revise or increase the applicable plan rental charges.
The payment under this subscription contract is exclusive of VAT. If any VAT/Tax is imposed in connection with any services under this subscription contract, it will be added to the invoice as applicable for payment as per the laws framed by State of Kuwait

Fifth: Roaming Services

Roaming services are added to the subscriber’s number upon request. The subscriber acknowledges that the quality of roaming services depends directly on the service quality of external telecom providers.
The subscriber is subject when using roaming services outside Kuwait to the regulations and laws governing these services in that country.
If the subscriber cancels roaming services, the company reserves the right to charge any remaining amounts received from international operators even after the subscription has ended. These charges will be applied to the subscriber’s contract after subscriber approval.

Sixth: Privacy and Account Details

The Subscriber authorize the company to verify the subscriber details from the Public Authority for Civil Information if required.
The Company has the right to contact directly to the subscriber relative or authorize any third party to contact them for obtaining any information if the subscribers filed to pay the dues in time.
The Company has the right to contact the employer of the Subscribe through any means if the subscriber files to pay the dues in time.
The Company shall not be held liable in case subscriber shares confidential OTP’s to any entity and the subscriber shall pay the company all charges imposed accordingly.
The subscriber has the right to request the deletion of their personal data, and they also have the right to modify it, provided they submit proof of its accuracy. (After commitment ends if applicable).
The subscriber has the right to correct or delete their personal data, restrict access to it, or object to its processing, as well as request the transfer of their personal data. This can be done through the company’s call centers, website, or any other method specified by the company for this purpose.
The subscriber acknowledges that all information and data provided to the company are correct and complete. And if he makes changes to it, the subscriber must notify the company immediately. If it is proven that he is Provided false or fake information, it may result in contract termination and service suspension, with the subscriber remaining liable for all outstanding dues.
The subscriber must not disclose their personal identification number (PIN), personal unblocking key (PUK), or customer service access code to prevent unauthorized users.
The company has the right to collect and share subscriber information with government authorities in accordance with law and the legal regulations issued by the Communications and Information Technology Regulatory Authority. Also, The company has the right to conduct credit assessments of the subscriber based on their payment behavior and usage patterns.
The company has the right to process subscriber information for commercial and marketing purposes to enhance services, obtaining the subscriber’s approval.
The company has the right to authorize a third party, such as debt collection agencies, to collect outstanding amounts from the subscriber. The company will provide the necessary data and documents and has the right to transfer rights in accordance with civil law regulations.
The company maintains the confidentiality of the subscriber›s information and call details and may not disclose it except upon request from legally authorized official entities or in the presence of the subscriber personally or through an official power of attorney that permits disclosure. If this data is not available through the company›s application, it will be provided after the subscriber pays the prescribed administrative fees, either through their account on the company’s official website or electronically.

Seventh: Privacy Protection Regulations – Ensuring the Safety and Security of Your Data

stcapplies global standards related to data protection in general and personal data in particular. These standards align with the regulatory framework issued by the Communication and Information Technology Regulatory Authority. Here, we outline the mechanism for handling personal data in terms of collection, use, protection, and storage, as well as the rights of the data owner:

Data Collection: The Company shall collect the personal data within the limits approved by the regulatory framework issued by the Communication and Information Technology Regulatory Authority, as stipulated in Registering Subscriber Data Regulations.
Data Usage: The Company shall use the personal data for the preparation of commercial and marketing studies, within the limits permitted by applicable laws and regulatory provisions.
Data Protection: We implement strict security measures to safeguard your personal data. These include protecting your data from unauthorized access, alteration, loss, or misuse through advanced technical controls such as access restrictions, encryption, data masking, minimization, obfuscation, and regular reviews to evaluate the effectiveness of these measures.
Your Rights: The subscriber has the right to access, update, or delete their personal data at their discretion through the company’s contact centers, its official website, or any other means designated by the company for this purpose, provided that proof validating the accuracy of the updated data is submitted.
Data Sharing: Your personal data will not be shared with third parties without your explicit consent, unless required by the terms and conditions of the subscription contract, the provisions of the Kuwaiti law, or for legal and security purposes.
Data Storage: Your personal data is stored within the State of Kuwait on company-owned servers, which are protected by robust security measures in accordance with the latest technologies.

Eighth: Service Suspension or Termination

The company has the right to suspend or terminate service, either temporarily or permanently, in the following cases:

Failure to pay outstanding dues will suspend some services or the temporary or permanent termination of the subscription until the subscriber settles the pending payments.
Upon request from official authorities or relevant entities in the country.
In cases of subscriber bankruptcy, insolvency, or if their assets are seized.
If the subscriber breaches the terms of the contract signed with the company.
In the event of the subscriber’s death.
Due to force majeure, exceptional circumstances, or emergencies.
If the SIM card is lost or stolen, the subscriber must immediately notify the company and request line suspension.
If a prepaid line is purchased but remains inactive for 180 days from the date of purchase.
If the subscriber has outstanding debts related to other subscriptions or services.
Subscriber will be subject to a KD 5 processing fee at the time in which they wish to terminate the subscription or migrate from postpaid to prepaid. The processing fee will apply for committed and non- committed postpaid subscribers.

Ninth: Internet Services

If a subscriber is enrolled in an unlimited internet plan, they will be subject to the company’s «Fair Usage Policy,» approved by the Communications and Information Technology Regulatory Authority. This policy applies according to the usage policy of each service, and the company has the right to increase or decrease the subscriber’s daily usage limit according to this policy. If the subscriber exceeds this limit, the internet speed will be significantly reduced until the end of the day without imposing any additional fees or subscriptions. The subscriber acknowledges that they have no right to terminate the contract or request compensation due to speed reduction or the application of the Fair Usage Policy.
Internet and multimedia services operate automatically with all subscriptions. If the subscriber does not wish to use them, they must deactivate them. The subscriber acknowledges that some modern mobile devices (smart applications) automatically connect to the internet for updates and software upgrades. In all cases, the subscriber is responsible for the internet connection fees incurred through their subscription, as per the company’s announced rates.
The subscriber acknowledges that download speeds may vary from time to time based on network congestion at the time of usage.

Tenth: General Terms and Conditions

The subscriber is required to follow the company›s instructions related to each service provided to them.
The subscriber’s contract can be transferred to another subscriber as specified by the regulations of the Communications and Information Technology Regulatory Authority, following the public procedures for communications and transferring related information. The new subscriber must comply with all the terms and conditions of the contract.
If the subscriber obtains value-added services from a third party through the company›s network, the relationship is directly between the subscriber and the third party regarding the service. The subscriber is solely responsible for dealings with the third party.
The subscriber only has the right to use the subscription number, and the company reserves the right to revoke or resell the number if the service is permanently disconnected.
If the subscriber wishes to transfer the contract to another person, the subscription, along with the current package and services, will be transferred according to the company’s customer contract transfer policies and the relevant regulatory decisions from the Communications and Information Technology Regulatory Authority.
If the subscriber requests the addition of a new service or modification of an existing service through the customer service center, the company’s website, or short text messages, the service can only be changed after the agreed-upon period for that service has passed, or after the prescribed payments, if any, are made.
Either party has the right to cancel the contract at any time unless the subscriber has committed to a specified period to receive the company’s services or offers, as mentioned in the contract. In all cases, the subscriber must pay the amounts due under the contract.
Subscription contracts are subject to the laws and regulations of the State of Kuwait, as well as relevant regulatory decisions, in accordance with Kuwaiti law, without violating Islamic Sharia.
In case of a conflict between the Arabic and English versions of any written text, the Arabic version shall prevail.
The Subscriber agrees that the company has the right to block the use of the mobile device on the company’s network by blocking the IMEI number in case the subscriber fails to pay the outstanding amounts. The block will be lifted once the outstanding obligations related to the device are paid.
Third parties do not have the right to claim exemption from the application of this clause due to ownership transfer of the device, but they may settle the outstanding amounts on the device in order to lift the block from the company’s network.

Eleventh: Annual Subscription Terms and Conditions

Annual Subscription: The company offers a range of deals to its subscribers, including special benefits and services such as devices, call minutes, text messages, and Internet for a specified period. The subscriber must commit to paying a fixed monthly amount for the duration of the annual subscription.
The annual commitment details are stated at the beginning of the subscription contract details the benefits and services the subscriber will receive.
After consuming the minutes, messages, and internet capacity included in the subscription plan, the applicable rates for services outside the subscription will be charged according to the regulations of the Communications and Information Technology Regulatory Authority.
The subscription contract will continue at the same monthly rate after the annual subscription period ends unless either party expresses a desire to terminate the contract.
Subscriber will be subject to a KD 2 processing fee at the time in which they wish to renew their postpaid plan subscription or subscribe to a new commitment.
A subscription can be temporarily suspended for a period of one month or three months, and this can only be done once within a year, following the procedures established by the company for such cases. Additionally, the subscription can be transferred to another subscriber before the end of the commitment period, provided that all due amounts for this commitment are paid.
The subscriber must pay the cancellation fees mentioned in the subscription contract in the following cases:
Subscribers can retain subscription numbers upon full payment of cancellation fees and dues.

If the subscriber requests to cancel the contract before the specified period ends.

In cases where the subscriber refrains or stops paying their bills at the specified times, as a result of that the company will disconnect the service according to the regulations and decisions issued by the Communications and Information Technology Regulatory Authority, and the cancellation fees outlined in the subscription contract will apply and a collection fee of KD 15 will be applied.

If one of the cases outlined in Clause 7 of this document occurs.

The subscriber has the right to retain their subscription number if he wishes to cancel the contracted service, provided that the cancellation fees mentioned in the subscription contract and any outstanding amounts are paid.
The subscriber must pay the value of the subscription contract even if they did not use or benefit from the services for any reason. The subscriber acknowledges that failing to pay the subscription will result in temporary suspension of the subscription.
As per company policy, the subscriber shall make an advance payment for the offer.
The subscriber admits that he/ she has received the devices.

Device Warranty

The warranty is automatically voided. If the device is repaired at an unauthorized service center.
The subscriber commits to maintaining the device and using it carefully, avoiding the use of unauthorized or counterfeit software, such as «Jailbreak» on an iPhone. In the event of such usage, the warranty will be voided, and the device will no longer be covered under the one-year warranty.
If the device is misused, it will not be replaced under the warranty.

Apple watch:

The subscriber will be charged every time he/she changes the eSIM.
All standard services will be consumed from the postpaid/prepaid mobile plan, and additional charges may apply in case of exceeding the allowance on the plan.
In case the subscriber has prepaid line, he/she has the right to connect only with an Apple watch. If the subscriber has a Postpaid line, he/she has the right to connect with a maximum of 5 Apple watches.
In case of activation of roaming services, the subscriber must know that the service will not work on an Apple watch, but will still able to use most of the features of the service if it Is connected to a phone via Bluetooth.
In case of termination or cancellation of the line, the subscriber is obliged to pay the full amount of the Apple watch after deducting the paid installments.
